Article 1: General

The e-commerce website (Site) of Brugse Boekhandel, a limited company, with registered office at 2 Dijver, 8000 Bruges, Belgium, VAT Registration No. BE0888.246.816, RPR Brugge (Brugse Boekhandel) offers its customers the opportunity to buy products online from its webshop.
The present Terms and Conditions (Conditions) apply to any order placed on the online shop website by a visitor (Client). By placing an order on the Site, the Client expressly accepts that these Conditions apply, to the exclusion of any other conditions.
Additional conditions made by the Client are excluded, with the exception of those previously explicitly accepted in writing by Brugse Boekhandel.

Article 2: Price:

All prices are shown in Euros, inclusive of VAT and exclusive of carriage and transaction charges (which are always shown before you finally confirm the order).
The published prices refer only to the articles as they are described. Accompanying photos are for illustration and may contain items which are not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and website have been most carefully compiled, it is possible that the information provided is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer are not binding on Brugse Boekhandel. As to the accuracy and completeness of the information provided, Brugse Boekhandel is only committed to make its best efforts and is in no way liable in case of material errors, setting or printing errors.
Clients who have specific questions about availability, delivery date or means of delivery, for example, are asked to contact our customer service department in advance.
The offer is valid so long as stocks last and may be changed or withdrawn by Brugse Boekhandel at any time. Brugse Boekhandel cannot be held liable for non-availability of a product. If an offer has a limited validity or is made subject to conditions, this will be expressly stated in the offer.

Article 4: Buying online

Ordering

Select the book you wish to order and click on ‘Toevoegen aan winkelwagen’ “Add to cart".
Once all the books are added, go to the shopping cart icon at the top and you will see a summary of your order.
To send your order, click on Bestelling afronden "Checkout".
Here you fill in the form with your details. You can choose to create an account or to complete your order as "guest".
After selecting despatch and payment methods, you will see another summary of your order, this time with carriage charge included.
Brugse Boekhandel has the right to refuse an order in the event of a serious breach by the Client in respect of orders with which the Client is involved.

Payment

The Client has the following choice of methods of payment:
Bank transfer to Account BE23 7330 4108 5691.
Bancontact/MisterCash, Maestro, iDeal, GiroPay, Sofortbanking, Mastercard/VISA or payment on collection.
Clients are directed to the secure website of payment service provider Mollie, through which payment is made.

Article 5: Delivery and performance of the contract

Articles ordered from the online shop are currently delivered to Belgium, Luxemburg, the Netherlands, France, Germany, the United Kingdom, Austria, Czech Republic, Denmark, Finland, Greece, Hungary, Ireland, Italy, Poland, Portugal, Spain, Sweden, Switzerland, the United States, Canada, Australia and Japan.
If your country is not listed here, you can always send an e-mail to administratie@brugseboekhandel.be with possibilities for shipping to your address.
Delivery is made through DPD and BPost, in accordance with their terms and conditions.
Normal delivery time for Belgium is two working days from recept of payment (depending on the stock available in the shop).
Delivery time outside Belgium depends on country and region.
The Client should report any visible damage and/or deficiency in quality or other problem with the delivery to Brugse Boekhandel.
The risk of loss or damage passes to the Client from the moment he/she (or a third party nominated by him/her, who is not the carrier) takes physical possession of the goods. However, the risk passes to the Client upon delivery to the carrier if the latter has been engaged by the Client to transport the goods and this choice was not offered by Brugse Boekhandel.

Article 6: Right of cancellation

The provisions of this article only apply to Clients who buy articles online from Brugse Boekhandel as individual consumers.
The Client has the right to withdraw from the contract within 14 calendar days without giving reasons.
This withdrawal period expires 14 days from the day on which the Client, or a third party nominated by the Client who is not the carrier, has physically received the goods.
To exercise the right of withdrawal, the Client must inform Brugse Boekhandel (Dijver 2 - 8000 Bruges - 050/33.29.52 - info@brugseboekhandel.be) of his/her decision to cancel through an unambiguous declaration (e.g. in a letter sent by post or via e-mail). For this, the Client can, but is not obliged to, make use of the attached template (see Appendix 1).
To comply with the revocation deadline, the Client must send notice of withdrawal before expiry of the cancellation period.
The Client must send or bring the goods back to Brugse Boekhandel - Dijver 2 - 8000 Bruges immediately but in any case, no later than 14 calendar days after the day he/she informed Brugse Boekhandel of cancellation.
Costs of return are for the Client's account.
If the value of the returned product has been diminished in some way, Brugse Boekhandel reserves the right to hold the Client liable and to demand compensation for any reduction in value resulting from the Client's handling of the goods beyond what is necessary to check the state, characteristics and working of the goods.
Only articles in their original packaging, with all accessories, instructions and invoice or proof of purchase will be taken back.
If the Client cancels the contract, Brugse Boekhandel will reimburse all payments received from the Client up to that point, including standard delivery charges, within 14 calendar days after receiving notice of the Client’s decision to withdraw from the contract. For sales contracts, Brugse Boekhandel can withhold reimbursement until all goods are returned or until the Client has proved that he/she has returned the goods, depending which happens first.
Any additional expenses resulting from the Client choosing a delivery method other than the best value standard delivery offered by Brugse Boekhandel will not be reimbursed.
Brugse Boekhandel will use the same payment method to reimburse the Client as the original transaction, unless the Client has expressly agreed otherwise. In any event, no costs will be charged to the Client for such reimbursement.

Article 8: Privacy statement

Brugse Boekhandel, the data processor, respects the Belgian Act of 8 December 1992 regarding protection of privacy in processing personal data.
The personal data you entrust to it should only be used for the purpose of fulfilling and delivering your order.
You have a legal right to examine your personal data and to correct them where necessary. Subject to provision of proof of identity (identity card copy), you can obtain written notification of your personal data free of charge by sending a signed and dated written request to Brugse Boekhandel - Dijver 2 - 8000 Bruges – Belgium, info@brugseboekhandel.be . If necessary, you can also ask for any incorrect, incomplete or irrelevant data to be corrected.
In the event that data is used for direct marketing: you can object to such use free of charge by contacting Brugse Boekhandel at any time. We treat your personal data as confidential information and will not transfer, hire or sell them to third parties.
The Client is responsible for keeping his/her login details confidential and for the use of his/her password. Your password is stored in encrypted form, so Brugse Boekhandel has no access to it. Brugse Boekhandel keeps online (anonymous) visitor statistics to see which pages on the site are visited and to what extent.

Article 9: Use of cookies

During a visit to the website, cookies may be placed on the hard drive of your computer. A cookie is a text file placed in the browser of your computer or mobile device when you consult a website. Cookies cannot be used to identify individuals, only machines.
The following cookies are used on our website: "First party cookies" (technical cookies used by the website itself to optimise its functioning; for example, remembering settings used by the visitor, or details the user already provided during previous visits).

Article 10: Impairment of validity - non-renunciation

If a provision of these Conditions is declared invalid, illegal or void, this shall in no way impair the validity, legality and applicability of the other provisions of these Conditions.
Similarly, if Brugse Boekhandel were to omit at any point to enforce one of these provisions or to exercise any rights in this respect, this shall never be interpreted as renunciation of such provision and shall never impair the validity of these rights.

Article 11: Amendment of terms and conditions

These Conditions are complemented by other conditions, where an explicit reference is made to them, and by the general conditions of sale of Brugse Boekhandel. In the event of conflict, the terms and conditions published here take precedence.

Article 12: Evidence

The Client accepts that electronic communications and back-ups can be used as evidence.
Brugse Boekhandel has signed up to the Code of Conduct of the Unizo E-commerce Label. A copy of this Code of Conduct and access to UNIZO’s complaints procedure can be obtained from http://www.unizo.be/ecommercelabel/ .

Article 13: Applicable law - disputes

Belgian law is applicable with exception of the provisions of international private law concerning applicable law.
The tribunals of the consumer's place of residence are competent in case of legal disputes. The consumer may also refer the matter to the European Consumer Centre’s online dispute resolution via the ODR platform: (http://ec.europa.eu/consumers/odr/).
Brugse Boekhandel has signed up to the Unizo E-commerce Label Code of Conduct.
The Code of Conduct is available from http://www.unizo.be/ecommercelabel/, where you will also find an alternative means of resolving complaints and disputes without resorting to law through the UNIZO complaints procedure.
